Para esto hemos dise\u00f1ado una pol\u00edtica de almacenamiento y tratamiento de la informaci\u00f3n que nuestros clientes suministran a trav\u00e9s de los diversos canales de comercializaci\u00f3n de nuestros productos y servicios (tales como sitios web, portales de reservas en l\u00ednea, v\u00eda telef\u00f3nica), y estamos comprometidas con la protecci\u00f3n y manejo adecuado de los mismos, conforme el r\u00e9gimen legal de protecci\u00f3n de datos personales<\/p>\n\n<p><strong>CHAPTER I GENERAL REGULATIONS<\/strong><\/p>\n\n<p>ARTICLE 1. DEFINITIONS. OBJETO. El presente documento tiene la finalidad de regular los procedimientos de recolecci\u00f3n, manejo y tratamiento de los datos de car\u00e1cter personal que realiza SANTA HELENA ISCALA S.A.S., a fin de garantizar y proteger el derecho fundamental de habeas data de sus hu\u00e9spedes, visitantes, clientes, usuarios y proveedores en el marco de lo establecido en la ley. Todo lo anterior en cumplimiento a lo previsto en el literal (k) del Art\u00edculo 17 de la Ley 1581 de 2012, que regula los deberes que asisten a los responsables del tratamiento de datos personales, dentro de los cuales se encuentra el de adoptar un manual interno de pol\u00edticas y procedimientos para garantizar el adecuado cumplimiento de la ley y en especial, para la atenci\u00f3n de consultas y reclamos.<\/p>\n\n<p>ART\u00cdCULO 3. \u00c1MBITO DE APLICACI\u00d3N. El presente manual ser\u00e1 aplicable a los datos personales registrados y por registrar en las diferentes bases de datos manejadas por SANTA HELENA ISCALA S.A.S., esto es, a las bases de datos de nuestros hu\u00e9spedes, visitantes, clientes y proveedores, que nos suministren sus datos para fines comerciales.<\/p>\n\n<p>La informaci\u00f3n que recolecta SANTA HELENA ISCALA S.A.S., puede incluir, en todo o en parte seg\u00fan las necesidades de cada producto y\/o servicio, entre otros los siguientes datos:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Names and surnames.<\/li>\n\n<li>Type and identification number.<\/li>\n\n<li>Nationality and country of residence.<\/li>\n\n<li>Date of birth and gender.<\/li>\n\n<li>Marital status and\/or relationship in relation to minors or disabled persons requesting our services.<\/li>\n\n<li>Landlines and cell phones for contact (personal and\/or work).<\/li>\n\n<li>Postal and electronic addresses (personal and\/or work).<\/li>\n\n<li>Profession or occupation.<\/li>\n\n<li>Company where you work and position.<\/li>\n\n<li>Origin and destination.<\/li>\n\n<li>Reason for your trip.<\/li>\n\n<li>Credit card information (number, bank, expiration date).\u00a0<\/li>\n\n<li>Personal data of the cardholder (names and surnames, type and identification number).\u00a0<\/li>\n\n<li>Address information where the cardholder receives their bank statements.<\/li>\n<\/ul>\n\n<p>This data may be stored and\/or processed on servers located in computer centers, whether owned or contracted with third-party providers, which is authorized by our guests, visitors, customers, users and suppliers by accepting this Privacy Policy.<\/p>\n\n<p>ARTICLE 4. ACCURACY OF THE INFORMATION. Por tanto, no asume responsabilidad por da\u00f1os y\/o perjuicios de toda naturaleza que pudieran tener origen en la falta de veracidad, vigencia, suficiencia o autenticidad de la informaci\u00f3n, incluyendo da\u00f1os y perjuicios que puedan deberse a la homonimia o a la suplantaci\u00f3n de la identidad.<\/p>\n\n<p>ARTICLE 5. APPLICABLE LEGISLATION. This manual was prepared taking into account the ordinances of Law 1581 of 2012 \"By which general provisions are issued for the protection of personal data\" and Decree number 1377 of 2013 \"By which Law 1581 of 2012 is partially regulated\" .<\/p>\n\n<p>ARTICULO 6. INFORMACI\u00d3N DE NI\u00d1OS Y ADOLESCENTES MENORES DE EDAD. SANTA HELENA ISCALA S.A.S. velar\u00e1 por el uso adecuado de los datos personales de los ni\u00f1os, ni\u00f1as y adolescentes menores de edad, garantizando que en el tratamiento de sus datos se respete el inter\u00e9s superior de ellos, y sus derechos fundamentales y en lo posible, teniendo en cuenta su opini\u00f3n, como titulares de sus datos personales.<\/p>\n\n<p>ARTICLE 7. Si el reclamo recibido no cuenta con informaci\u00f3n completa que permita darle tr\u00e1mite, esto es, con la identificaci\u00f3n del Titular, la descripci\u00f3n de los hechos que dan lugar al reclamo, la direcci\u00f3n, y acompa\u00f1ando los documentos que se quiera hacer valer, se requerir\u00e1 al interesado dentro de los cinco (5) d\u00edas siguientes a su recepci\u00f3n para que subsane las fallas. Transcurridos dos (2) meses desde la fecha del requerimiento sin que el solicitante presente la informaci\u00f3n requerida, se entender\u00e1 que ha desistido del reclamo. Si por alguna circunstancia la Compa\u00f1\u00eda recibe un reclamo que en realidad no deber\u00eda ir dirigido contra \u00e9l, dar\u00e1 traslado a quien corresponda en un t\u00e9rmino m\u00e1ximo de dos (2) d\u00edas h\u00e1biles e informar\u00e1 de la situaci\u00f3n al interesado.<\/p>\n\n<p>2. Una vez recibido el reclamo completo, se incluir\u00e1 en la base de datos que mantiene SANTA HELENA ISCALA S.A.S. con una leyenda que diga \u201creclamo en tr\u00e1mite\u201d y el motivo del mismo, en un t\u00e9rmino no mayor a dos (2) d\u00edas h\u00e1biles. Dicha leyenda deber\u00e1 mantenerse hasta que el reclamo sea decidido.<\/p>\n\n<p>3. Al respecto se tendr\u00e1 en cuenta lo siguiente: En las solicitudes de rectificaci\u00f3n y actualizaci\u00f3n de datos personales el titular debe indicar las correcciones a realizar y aportar la documentaci\u00f3n que avale su petici\u00f3n.<\/p>\n\n<p>SANTA HELENA ISCALA S.A.S. tiene plena libertad de habilitar mecanismos que le faciliten el ejercicio de este derecho, siempre y cuando \u00e9stos beneficien al titular.
